Estate Planning & Prenups

Estate Planning

The attorneys at Giampolo Law Group are experienced in assisting clients with estate planning (specifically, in preparing or revising their wills, trusts and the other essential documents such as powers of attorney and hospital visitation forms).  Estate plans are necessary at any stage of life; more so when individuals form a relationship or family unit, estate plans protect assets and provide for loved ones.  In the event of a divorce or dissolution of a family union, it is imperative that any prior estate plans be revised because the terms of a divorce or dissolution agreement frequently render the terms and directives of an estate plan unenforceable.  Directives and trusts providing for pets are also common and necessary, in order to ensure that your animal companion is taken care of in the case of an accident or other life-changing event.

Prenuptial Agreements

Prenuptial agreements are essential in protecting assets such as a business or home, as well as the interests of children from a prior relationship.  A prenuptial agreement can prevent a legal battle over the distribution of assets and debt in the event of a divorce or dissolution of a relationship.  The purpose of a prenuptial agreement is to avoid such disputes by defining each individual’s rights and obligations prior to entering into a relationship.  The laws around prenuptial agreements are strict and the agreement must meet multiple legal requirements before it will be enforced.  There is no replacement for legal counsel when making agreements regarding a relationship: prenuptial, or otherwise.
